That’s the most popular question on the lips of the survivors of the shooting at Marjory Stoneman Douglas High School in Parkland, Florida, where a lone gunman killed 14 people and injured 17 others, most of them students. Since the shooting, more than a thousand students across the country have gone on strike to protest gun violence and put pressure on lawmakers to act. Almost all of them have been encouraged to do so by national gun-control organizations including Everytown for Gun Safety, which was founded by former New York Mayor Michael Bloomberg. The students' activism has been a powerful reminder to people of the power of the threat of gun violence. But we should ask ourselves: Why should the threat of gun violence provoke such widespread concern? There are many reasons. Guns kill far more people than do cars, bombs or knives, and make far more injuries. A person is 19 times more likely to be shot by a gun than to be killed in a traffic accident. Guns are the most common cause of death for children under the age of 14. Civil-liberty activists have fought for decades to lower the legal thresholds for invoking the “standing to defend” for legal authorities and the legal standing of legal authorities to invoke the “duty to stand” for citizens. The “use of deadly force” rule now requires far lower levels of threat to others to activate the duty of “use of deadly force.” A “reasonable person” who felt threatened of getting shot, or who saw someone shoot someone else, could now reasonably—and legally, if the shooting was justified—perceive himself to be in the midst of deadly danger from a gun and use deadly force in self-defense, and escape liability for that shooting.
